Pindigo Terms of Service

Welcome to Pindigo. By using our services, you agree to these Terms of Service. Please read them carefully.
1. Acceptance of Terms
- By using Pindigo, you agree to be bound by these terms.
- You must be at least 13 years old or the minimum age required in your jurisdiction.
2. User Accounts
- You must provide accurate information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- Accounts may be terminated for violations of these terms.
3. User Conduct
- You must respect others and not engage in harassment or illegal activities.
- Prohibited activities include spamming, hacking, and posting inappropriate content.
4. Content Ownership and Licensing
- You retain ownership of your content.
- By posting content, you grant Flippd, LLC a non-exclusive license to use, display, and distribute your content as described in these terms.
5. USER CONTENT AND MACHINE-LEARNING DEVELOPMENT
“User Content” means any photograph, image, score evidence, score value, pinball-machine selection or identifier, caption, comment, annotation, file metadata, or other content or information that you submit, upload, post, or otherwise make available through the Services.
You retain any ownership rights that you have in your User Content.
By submitting User Content to the Services, you grant Flippd, LLC, including its affiliates, successors, and assigns (“Company”), a worldwide, non-exclusive, royalty-free, fully paid-up, transferable, and sublicensable license to host, store, reproduce, display, publish, distribute, modify, crop, resize, convert, annotate, label, analyze, combine with other information, create derivative works from, and otherwise use the User Content for the following purposes:
(a) operating, providing, moderating, securing, maintaining, supporting, and improving Pindigo, Flippd, and related services;
(b) displaying, reviewing, validating, and verifying pinball scores and machine information;
(c) researching, designing, developing, training, fine-tuning, validating, testing, benchmarking, evaluating, monitoring, maintaining, and improving machine-learning and artificial-intelligence systems; and
(d) developing, providing, hosting, licensing, distributing, and commercializing models, model weights, software, application programming interfaces, products, and services developed through those activities.
The permission described above expressly includes using User Content as training, validation, testing, benchmarking, and evaluation data for systems that read pinball scores, identify or classify pinball machines, assess image quality, detect inaccurate or abusive submissions, and perform other functions related to pinball machines, gameplay, scoring, and the Services.
Company may use User Content to create annotations, labels, crops, data augmentations, statistical information, evaluation data, model parameters, model weights, algorithms, and other technical materials. Company may make resulting models, model weights, software, APIs, and services available to third parties, including under commercial licenses.
Unless we separately notify you and obtain any permission required by applicable law, Company will not sell or license your original User Content as a standalone image dataset or provide your original User Content to a customer merely because that customer licenses or uses a model developed by Company.
Company may permit its employees, contractors, service providers, and research partners to process User Content on Company’s behalf for the purposes described above, subject to appropriate confidentiality, security, and use restrictions.
As between you and Company, Company owns its models, model weights, algorithms, software, annotations, labels, compilations, evaluation results, and other materials that it creates, subject to any rights that you retain in your original User Content. You do not acquire an ownership interest in, or a right to receive compensation, royalties, or other payment from, a model, product, or service merely because your User Content was used to develop, test, or improve it.
6. YOUR RESPONSIBILITIES FOR USER CONTENT
You represent that you took the photograph or otherwise have sufficient rights and permission to submit the User Content and grant the permissions described in these Terms.
You may not knowingly submit User Content that is unlawful, confidential, materially infringes another person’s rights, or contains sensitive personal information that is not reasonably necessary for a pinball-score or machine submission.
Unless you have all permissions required by applicable law, do not submit images containing clearly identifiable people, identifiable children, private documents, home addresses, access credentials, financial information, government identifiers, or precise location information.
Company may reject, remove, crop, blur, redact, or otherwise minimize User Content that contains unnecessary personal or sensitive information.
7. DELETION, WITHDRAWAL, AND PRE-EXISTING MODELS
You may delete your account and eligible User Content by using https://pindigo.app/delete-account, or request that eligible User Content be excluded from future machine-learning development by contacting support@pindigo.app.
After we process a valid deletion or exclusion request, we will stop intentionally including the original User Content in new training, validation, testing, or benchmarking runs within 30 days. Copies may remain temporarily in security, disaster-recovery, or archival backups for up to 90 days, or for a longer period where retention is required by law.
To the extent permitted by applicable law, deleting User Content or withdrawing permission does not require Company to delete, disable, retrain, or stop using a model or other derived material created before the request, provided that the retained material does not contain the original User Content in recognizable form and does not reasonably identify you or permit reconstruction of the original User Content.
The license granted in these Terms remains effective, to the extent necessary, for models and other derived materials created before Company processed the deletion or exclusion request. This paragraph does not limit any non-waivable rights that you may have under applicable privacy or data-protection law.
8. Limitation of Liability
- Pindigo is provided “as is” without warranties of any kind.
- Flippd, LLC is not liable for indirect, incidental, or consequential damages.
9. Governing Law
- These terms are governed by the laws of the State of Wisconsin, United States.
- Any disputes will be resolved in the courts of the State of Wisconsin, United States.
10. Modifications to the Terms
- Flippd, LLC reserves the right to modify these terms at any time.
- Users will be notified of significant changes via email or in-app notifications.
